Unless otherwise and explicitly expressed, it is prohibited to reuse, i.e. copy, distribute, publish, download, modify or transfer content, such as documents, graphics, scripts, web pages, photographs, images, texts, audio and video sequences displayed or featured on the Site for commercial purposes without first obtaining the written consent of TALLY WEiJL.

TALLY WEIJL, TOTALLY SEXY are registered trademarks of TALLY WEiJL Holding AG, Industriestrasse 13b, 6300 Zug / Switzerland. All other brands are property of the corresponding brand owners.

You may not use, copy, distribute, publish, download, modify, transmit, remove, etc. trademarks in any way without prior written consent from TALLY WEiJL.

No licensing

Unless otherwise indicated, neither licenses nor any other right of use for copyrights, trademarks or other proprietary rights in connection to this Site’s content will be issued unless TALLY WEiJL and/or its group companies and/or other owners has/have granted prior written permission for the use of such proprietary rights.

Disclaimer of Warranty

No warranties are made – whether expressly or implied – in regard to the information contained on the Site in terms of its quality, fitness, accuracy, pertinence, usefulness or correctness. Furthermore, no guarantees are made that the Site will function uninterrupted or error free, or that the web server be virus-free or hacker-resistant.

Limitation of Liability

Neither TALLY WEiJL nor any of its group companies, management board or administrative board members ("officers”), shareholders, employees or any other party involved in creating the Site will be held liable for any direct or indirect loss or damages, intangible damages, consequential damage, damages incurred as a result of use or supposed non-usability, as well as those damages resulting from viruses, hackers, service loss and interrupted connection, and those caused by incomplete or incorrect information contained on the Site. TALLY WEiJL maintains the right to monitor and control all content, contributions, communications, forums, comments etc. published by you or other users on this Site. TALLY WEiJL has the absolute right to block or remove third-party communications and content. TALLY WEiJL is neither responsible nor liable for any errors, libel, slander, discrimination, obscenities, pornographic material etc. ensuing from such published content and any other information it deems not in accordance with these terms and conditions.

Misuse of the Site

You are prohibited from using the Site to post, transmit or publish any material which is or may be considered libellous, slanderous, obscene, abusive, pornographic, discriminating, illegal or any material that could constitute or encourage conduct that would be considered a criminal offence, violate the rights of any party or which may otherwise give rise to civil liability or violate any law. You are also prohibited from using the Site to advertise or perform any commercial solicitation, whether for your own merchandise or services or that of a third party. You guarantee that all content published by yourself does not fall into the category of misuse as described above.

Privacy Policy

Any personal information you disclose within this Site, such as name, address, date of birth, gender, E-Mail address etc. is done so on an entirely voluntary basis. This information ("data") is submitted to us when, for example, you participate in sweepstakes, forums, chats and surveys. Your data may also be used for advertising campaigns and marketing purposes, as well as for other services and product offers requiring you to register or log in. Upon request we will send you information about special offers and other news from TALLY WEiJL on a regular basis either by E-Mail or SMS text messaging.  It is at any time possible to change your personal information or delete it entirely from our database; you may also terminate the delivery of information via E-Mail or SMS text messaging. You personal data is processed and used in strict adherence to the current data protection laws.

We use "cookies" to collect statistical data about your visits to our Site and to improve the Site’s usability. In adherence to the data protection law, we neither collect nor store personally identifiable information through the use of cookies.

Please be aware that the online submission of your data to TALLY WEiJL is unencrypted. Applicable Law and Jurisdiction

All disputes arising in connection with this Site submit to the exclusive jurisdiction of the Swiss Courts. These terms and conditions shall be governed by the laws of Switzerland.

General Terms and Conditions for the Use of the TALLY WEiJL Gift Card

1. The TALLY WEiJL Gift Card (hereinafter the "Gift Card") allows to purchase cashless TALLY WEiJL-goods in all TALLY WEiJL-Boutiques and sales points as determined from time to time by TALLY WEiJL up to the credit balance loaded onto the Gift Card. The current balance of the card will appear on the receipt after effecting a purchase with the Gift Card or can be requested in any affiliated TALLY WEiJL-sales point.
2. The Gift Card will be activated upon payment of the desired credit balance. The maximum credit balance is EUR 300/CHF 300. The card is valid for a period of three years from its activation. After the expiry date of the card, any remaining credit balance can be transferred to a new card within 12 months.
3. If the balance of the card has been fully used up with a purchase transaction, then any remaining amount payable to complete the transaction can be settled by any means of payment commonly accepted in the TALLY WEiJL-sales points, or the Gift Card can be replenished with a new credit balance.
4. Any balance remaining on the Gift Card after a purchase can be applied to any successive purchase. No interest shall be paid on the remaining balance of the Gift Card. A refund in cash of such balance is excluded.
5. The owner of the Gift Card shall be responsible for the safe custody of the card and shall prevent any unauthorized use by third parties. Any person using the Gift Card is deemed to be its lawful owner and, therefore, the TALLY WEiJL-sales point are allowed to charge any purchase made with such card. Gift Cards which have been lost or stolen shall not be refunded or replaced with new cards. TALLY WEiJL rejects any responsibility for any abuse or misuse committed with the Gift Card.
6. Any abuse or misuse of the Gift Card is prohibited. TALLY WEiJL reserves the right to block and confiscate the Gift Card at any time without refund if any abuse or misuse of the card is ascertained.
7. The use of the Gift Card implies the acknowledgement and recognition of these General Terms and Conditions. TALLY WEiJL may amend these General Terms and Conditions at any time.
8. These General Terms and Conditions for the purchase and the use of the Gift Card shall be governed in all respects by the substantive laws of the place of purchase of the Gift Card.
